Terms of Use (TOU)
1. Definitions
When the terms below are used with a capital letter, they refer to their respective definitions.
Administrator: any person, department or company responsible for administering the Site, operating it and implementing the resources necessary for its functioning, acting under the instructions of GL EVENTS SUPPORT.
Content: any information, element and/or media, regardless of format, intended to be published on the Site.
Operation: maintenance of the Site in operational conditions.
Incident: unplanned interruption or degradation of the quality of an IT service provided online on the Site.
Parties: collectively refers to the Users of the Site and GL EVENTS SUPPORT.
Services: all online services provided by GL EVENTS SUPPORT to Users through the Site, as defined in Article 8 below.
Site: all structured documents, called “web pages”, composed of content of various nature and formats (text, image, sound, video, etc.), powered by software and stored on a server connected to the internet, forming the technical support of the URL mentioned in the above Legal Notice.
User: any natural person legitimately connected to the Site, acting in a professional context.
2. Purpose of the Terms of Use
These “Terms of Use” (hereinafter the “TOU”) define the conditions under which any User may use the Services provided by GL EVENTS SUPPORT through the Site.
3. Effective Date – Duration
These TOU apply to any User of the Site.
4. Enforceability of the Terms of Use
These TOU may be amended by GL EVENTS SUPPORT whenever deemed necessary, which the User expressly accepts in advance. GL EVENTS SUPPORT shall publish and make accessible on the Site any new version of the Terms of Use.
5. User Responsibility
Mode of proof
In their relations, the Parties agree to correspond by email, except for specific cases requiring the use of registered letters with acknowledgment of receipt. Any email sent shall constitute acceptable proof for establishing any fact, act or action of either Party.
Limitation of liability
No limitation of liability or warranty is granted to the User for any breach of any of the obligations arising from these Terms of Use.
Consequently, the User shall be responsible for any damage, including direct, indirect, consequential, special or incidental damages, whether physical and/or moral, material and/or immaterial, caused to other Parties or third parties through the use of the Services or connection to the Site. GL EVENTS SUPPORT uses its best efforts to ensure the accuracy of the information published on the Site. However, Users are solely responsible for verifying such information, and GL EVENTS SUPPORT provides no guarantee in this respect. Its liability cannot be engaged in the event of inaccurate or incomplete information published on the Site.
Non-waiver
The fact that GL EVENTS SUPPORT does not enforce any clause of these TOU, or tacitly agrees to its non-performance, whether permanently or temporarily, shall not be interpreted as a waiver by GL EVENTS SUPPORT of the rights resulting from such clause or its future enforcement.
Breach of these TOU
Any misuse of the Site or its functionalities, contrary to their purpose and intended use, is strictly prohibited and constitutes a breach of these TOU, and may result in the suspension of the User’s account, temporarily or permanently, at the discretion of GL EVENTS SUPPORT.
6. Intellectual Property
GL EVENTS SUPPORT is the exclusive holder of all intellectual property rights pertaining to the Site, including usage rights, display rights, operation rights, reproduction rights, representation rights, adaptation rights and translation rights relating to all elements composing the Site, including graphic designs, titles, layouts, texts, articles, analyses and writings, documentation, photographs, images, videos, and any informational and/or downloadable content, as well as trademarks and logos distributed by GL EVENTS SUPPORT.
The photos and visuals on the Site are non-contractual.
The Site and its Content are protected by French copyright law (Articles L.122‑4 et seq. of the Intellectual Property Code), which prohibits total or partial reproduction without the consent of GL EVENTS SUPPORT. The User agrees to respect all copyrights, trademark rights and database producer rights, acknowledging that the databases created by GL EVENTS SUPPORT are its exclusive property. GL EVENTS SUPPORT grants the User only a private, non-collective and non-exclusive right of use for the content published on the Site, as well as authorization to reproduce such content in digital form on the computer used for consultation of the Site’s pages.
The User has no right to transfer or assign information obtained from the Site and is prohibited from creating any derivative work from the Site’s Content.
The Site and its components constitute a protected work under intellectual property law. Any representation, reproduction, modification, transmission, translation or more generally any exploitation of the Site or its technical or graphic components is strictly prohibited without prior authorization from GL EVENTS SUPPORT.
The provision of the Services does not entail any transfer of intellectual property rights, except the User’s right to use the Services provided online through the Site, as provided in these TOU and where applicable, in the contract between the User and GL EVENTS SUPPORT.
Any violation of this clause constitutes an act of infringement and may lead to civil and/or criminal proceedings. The use of hyperlinks pointing to or referring to the Site is also subject to prior written authorization from GL EVENTS SUPPORT, which may be obtained by email from the webmaster.
7. Right to Use the Online Services
The User agrees to provide accurate information during registration and during any online operation, as such information is required for the proper functioning of the Site and correct delivery of the Services.
The User agrees not to create a false identity that could mislead the Administrator or third parties.
8. Online Services
GL EVENTS SUPPORT provides the User, through the Site, with various online services including the consultation of information, access to transactional features (such as requesting quotes and ordering services), the creation and use of a user account, downloading documents, and contacting teams through dedicated forms.
Some services may also allow access to a personal space containing order history and enabling the management of certain account information.
Access to these services and the management of user accounts varies depending on the User category.
Users benefiting from a Packaged Stand have specific rights allowing them to configure their stand (choice of carpet and/or partition colors), select their allocations when included in their offer, and order complementary services. Their account is created directly by GL events teams or activated through a Single Sign-On (SSO) mechanism.
The personal data associated with this account cannot be modified directly by the User; any modification request must be submitted by email to the contact address provided on the Site.
Users not benefiting from a Packaged Stand may access the Site through an account created by GL events teams, in which case any modification request must also be submitted by email to the contact address on the Site. When the Site allows users to create their own accounts, the User may self-register and modify their personal information from their personal space, or request modifications via the contact address provided on the Site.
GL EVENTS SUPPORT reserves the right to modify, restrict or suspend all or part of the online services, particularly for technical, maintenance or regulatory reasons, without incurring any liability.
9. Required Configuration
To use the Site and its functionalities properly, the User must ensure that their software is regularly updated by their respective publishers.
The Site is responsive and adapts to all screen sizes, but a minimum resolution of 1280 × 1024 pixels is recommended.
The Administrator cannot guarantee the transfer, storage or printing of information published on the Site from or to the User’s system. The Administrator uses reliable technical devices, but GL EVENTS SUPPORT does not undertake any obligation of result concerning the security and durability of information published online, particularly given the uncertainties inherent to open networks such as the internet.
To meet User needs or improve the Site, GL EVENTS SUPPORT may update its functionalities.
Operation of the Site may be temporarily interrupted for maintenance or security purposes. No interruption or slowdown of the Site may give rise to claims or compensation of any nature, particularly in case of loss of connection, data or information.
The information relating to the use of the Site by Users may result in the use of “cookies”, enabling improved adaptation of its functionalities and optimization of browsing. Each User may refuse the storage of such cookies through the settings in their web browser.
10. Proper Use of the Site
The User agrees not to attempt to bypass security or protection systems on the Site and not to disrupt or impair its operation.
A User responsible for infecting all or part of the Site with viruses, worms, Trojan horses, logic bombs or any other disruptive technical device agrees to bear all resulting consequences, including financial liability, toward GL EVENTS SUPPORT or any affected third party.
In case of fraudulent, wrongful or illegal use of the Site, the User agrees to indemnify the Administrator for any resulting damage.
GL EVENTS SUPPORT may block or remove any Content that:
• Violates French laws, international treaties or public decency;
• Interferes with the functioning of the Site;
• Harms the legitimate interests of other Users or third parties;
• Damages the image, reputation or interests of GL EVENTS SUPPORT, its shareholders, subsidiaries, partners or clients.
GL EVENTS SUPPORT shall not be liable nor required to compensate any User or third party regarding such actions.
11. Claims
To be processed, any claim regarding the operation of the Site, its Content or any other related matter must be submitted by email to the contact address indicated on the Site.
No action will be taken concerning claims submitted by persons who are not duly identified or whose contact details are incomplete.
12. Limitation of Liability
No direct or indirect damages, including commercial or financial losses (loss of turnover, gross margin, opportunity), nor any damage to image, shall give rise to compensation by GL EVENTS SUPPORT.
13. Confidentiality
In accordance with trade secrecy, the Parties agree to maintain strict confidentiality regarding all information relating to the organization of online Services, Site Content and their online relationship.
14. Amicable Procedure
Any dispute relating to the interpretation and/or execution of these Terms of Use shall, where possible, be resolved through amicable negotiation between the Parties, which GL EVENTS SUPPORT shall attempt to facilitate. After a period of 30 calendar days without amicable resolution, the Parties may refer the matter to the competent courts.
By mutual agreement, this provision does not prevent the initiation of emergency proceedings, summary proceedings or ex parte applications.
15. Jurisdiction
In case of failure of the amicable procedure and in the presence of any dispute, exclusive jurisdiction is assigned to the Commercial Court of Lyon, notwithstanding multiple defendants or claims for indemnity, including summary or emergency proceedings as well as any claim based on Article L.442‑6 of the French Commercial Code.
16. Applicable Law - Contract Language
The TOU of the Site are governed by French law, regardless of the User’s nationality.
The language of reading, understanding and interpreting the TOU is French.
